Welcome to Bar & Batter . By accessing or using barandbatter.com or placing an order with us, you agree to the following Terms & Conditions. Please read them carefully. If you do not agree to these terms, please do not use this website or submit an order.

1. Business Model & Legal Compliance

Bar & Batter operates as a Maryland Cottage Food Business, which means all products are produced in a private residence and sold in accordance with Maryland Cottage Food Laws.

Under these laws:

  • Products may only be sold within the state of Maryland.

  • Interstate sales or shipping outside of Maryland are prohibited.

  • Cottage food items are not inspected by the state health department.

By placing an order, you acknowledge and agree to these limitations.

2. Order Submission Process

All orders must be submitted through our official order form.

By submitting an order request, you understand that:
​

  • Submissions are requests, not confirmed orders

  • Final pricing (including shipping, tax, and delivery fees) will be emailed within 24 hours

  • Production begins only after payment is received

  • Turnaround time is typically 72 hours for pickup, plus 1–2 days transit for shipped orders

  • Delivery is available within Maryland only for an additional fee

We reserve the right to refuse any order at our discretion.

3. Pricing & Payment

Pricing for bundles and products is listed on our site; however final totals may vary based on:

  • Shipping costs

  • Delivery fees

  • Taxes

  • Seasonal adjustments

Payment must be completed through the preferred method selected on your order form.

We do not store full payment details.

4. Shipping, Delivery & Pickup Policies

Pickup

  • Available in Annapolis, Maryland only

  • Customer must arrive at the scheduled time

Delivery (Maryland Only)

  • Delivery fees vary by distance and will be included in your final quote

  • Delivery dates may fluctuate due to traffic or weather conditions

Shipping (Maryland Only)

  • Estimated shipping cost: $8–$11, subject to seasonal and location-based changes

  • Shipment arrival dates may vary due to carrier limitations

  • We are not responsible for delays caused by the carrier

By placing an order, you acknowledge that shipping delivery times are estimates, not guarantees.

5. Refunds, Exchanges & Cancellations

Since all products are made to order, Bar & Batter does not offer:

  • Refunds

  • Returns

  • Exchanges​

If there is an issue with your order, please contact us within 24 hours of receiving it and we will evaluate concerns on a case-by-case basis.

Orders may not be canceled once production has begun.

6. Allergy Disclaimer

All products are made in a single kitchen that handles common allergens such as wheat, eggs, dairy, nuts, soy, and others. Although we take care in handling, we cannot guarantee zero cross-contamination.
 
By purchasing from Bar & Batter, you acknowledge and accept this risk.

7. Website Use & Intellectual Property

All content on barandbatter.com, including text, branding, images, product descriptions, and designs, is the property of Bar & Batter and may not be copied, distributed, or reproduced without permission.

8. Limitation of Liability

By using this site or purchasing our products, you agree that Bar & Batter is not liable for:

  • Reactions due to allergies or sensitivities

  • Missed deadlines due to shipping delays

  • Misuse or improper handling of products once picked up or delivered

  • Customer-provided errors (incorrect address, incorrect bundle selections, etc.)

To the fullest extent permitted by law, our liability is limited to the amount paid for the order in question.

Bar & Batter may update these Terms & Conditions at any time. Changes will be posted on this page with a revised update date. Continued use of the site constitutes acceptance of any updated terms.
